Basic concepts

• Site visitor — the person who visited the site https://natalibolgar.com/ without the purpose of placing the Order.
• User — an individual, a Site visitor who accepts the terms of the user agreement and wants to place an Order on the site https://natalibolgar.com/.
• Buyer — The User who placed the Order on the site https://natalibolgar.com/ for the purpose of purchasing goods for personal needs.
• TM "Natali Bolgar" — TM "Natali Bolgar" (location: Ukraine, 65003, Odessa, ul. Chernomorskogo Kazachestva, 103). The seller is a Ukrainian business entity. The goods are sold from the Seller's stores located in Ukraine.
• Seller-TM "Natali Bolgar" or other legal entity or individual entrepreneur, whose goods are placed in the Online store.
• Online store — An Internet site located on the Internet at the address https://natalibolgar.com/, where the Goods offered by the Seller for purchase are presented, as well as the terms of payment and delivery of the Goods to the Buyers.
• Website — https://natalibolgar.com/.
• Seller's Page — a Site page containing information about the terms of sale, delivery and return of Goods sold by the Seller, as well as other information that is essential for the conclusion and execution of the contract of sale of Goods.
• Product — clothing, shoes, accessories and other goods presented for sale on the Seller's Website.
• Order — a duly executed request of the Buyer for the purchase and delivery to the address specified by the Buyer of the Goods selected on the Site.

1. General provisions

1. The Seller sells Goods through the Online store at https://natalibolgar.com/.
2. By ordering Goods through the Online Store, the User agrees to the terms of sale of Goods set out below (hereinafter referred to as the Terms of Sale of Goods). In case of disagreement, the User must immediately stop using the service and leave the site https://natalibolgar.com/.
3. These Terms of Sale of goods, as well as information about the Goods presented on the Website, are a public offer in accordance with Article 633 of the Civil Code of Ukraine.
4. These terms and conditions may be changed by the Seller unilaterally without notifying the User/The buyer. The new version of the Terms and Conditions comes into force from the moment of its publication on the Website, unless otherwise provided.
5. The User Agreement (hereinafter referred to as the Agreement) comes into force from the moment the Seller sends the Buyer an electronic confirmation of Order acceptance when the Buyer places an Order without authorization on the Site, as well as from the moment the Buyer accepts the Order by phone 0 800 211 299.
1. The contract for the retail sale of Goods is considered concluded from the moment the Seller issues the Buyer a cash or commodity receipt or other document confirming payment for the goods.
2. By informing the Seller of your e-mail and phone number, the Site Visitor/User/The Buyer agrees to the use of these means of communication by the Seller, as well as by third parties engaged by him for the purpose of fulfilling obligations to Site Visitors/By users/Customers, for the purpose of carrying out promotional and informational mailings containing information about discounts, upcoming and current promotions and other events of the Seller, about the transfer of the order for delivery, as well as other information, directly related to the fulfillment of the Buyer's obligations under this Public Offer. When Making An Order, The User/The Buyer agrees that the Seller may entrust the performance of the Contract to a third party, while remaining responsible for its performance.
6. All rights and obligations under the Agreement concluded with the User arise directly from the Seller, and the Buyer, accepting this Agreement, fully understands and agrees that in the case of entering into a contract with the Seller other than TM "Natali Bolgar", TM "Natali Bolgar" is not a party to this agreement and does not bear obligations related to its performance, except as provided for in this Public Offer.
7. As part of the Order, TM "Natali Bolgar" provides the User with information support of the Contract concluded by the User with the Seller.

2. Subject of the agreement

1. The subject of the Agreement is to allow the User to purchase for personal, family, household and other needs not related to the implementation of business activities, the Goods presented in the catalog of the Online store at the address https://natalibolgar.com/.
2. This Agreement applies to all types of Goods and services presented on the Site, as long as such offers with a description are present in the catalog of the Online store.

3. Subject of the agreement

1. Registration on the Site is carried out using the pop-up window "Registration".
2. Registration on the Site is not mandatory for placing an Order.
3. The Seller is not responsible for the accuracy and correctness of the information provided by the User during registration.
4. The User undertakes not to disclose to third parties the username and password specified by the User during registration. If the User has any suspicions about the security of his login and password or the possibility of their unauthorized use by third parties, the User undertakes to immediately notify the Seller by sending an appropriate email to the address: info@natalibolgar.com.
5. User Communication/The interaction of the Buyer with the Call Center operators/managers and other representatives of the Seller should be based on the principles of generally accepted morality and communication etiquette. It is strictly prohibited to use obscene words, swearing, offensive expressions, as well as threats and blackmail, regardless of the form and to whom they were addressed.

4. Product and order of making a purchase

1. The Seller ensures that the Goods presented on the Site are available in its warehouse. The photos accompanying the Product are simple illustrations to it and may differ from the actual appearance of the Product. The descriptions/characteristics accompanying the Product do not claim to be exhaustive and may contain typos. To clarify the information about the Product, the Buyer should contact the Customer Support Service. The information provided on the Site is updated every 24 hours.
2. If the Goods ordered by the Buyer are not available in the Seller's warehouse, the latter has the right to exclude the specified Goods from the Order/cancel the Buyer's Order, notifying the Buyer by sending an appropriate email message to the address specified by the Buyer during registration (or by calling the operator of the Call Center of TM "Natali Bolgar").
3. The Buyer is fully responsible for providing incorrect information, which resulted in the inability of the Seller to properly fulfill its obligations to the Buyer.
4. In the event of cancellation of a fully or partially prepaid Order, the value of the canceled Product is returned by the Seller to the Buyer in the manner in which the Product was paid for.
5. The Buyer's order is placed in accordance with the procedures specified on the Website in the "Delivery and payment" section at the address https://natalibolgar.com/delivery_payment/
6. After placing an Order on the Website, the Buyer is provided with information about the expected delivery date by sending an email to the address specified by the Buyer during registration, or by phone. The Manager serving this Order specifies the details of the Order, agrees on the delivery date, which depends on which legal entity/individual entrepreneur is the Seller of the Goods ordered by the Buyer, the availability of the ordered Goods in the Seller's warehouse and the time required for processing and delivery of the Order.
7. The expected date of delivery of the Order to the Delivery Service is reported to the Buyer by the manager serving the Order, by e-mail or during a control call to the Buyer. The date of delivery of the Goods may be changed by the Seller unilaterally if there are objective, in the Seller's opinion, reasons.

5. Order delivery

1. The goods are delivered by the postal operator in the form of a postal item with cash on delivery. Methods, as well as approximate terms of delivery of Goods are indicated on the Website in the section "Delivery and payment" at https://natalibolgar.com/delivery_payment/. Specific delivery times can be agreed by the Buyer with the Call Center operator when confirming the order.
2. The territory of delivery of the Goods presented on the Site is limited to the borders of Ukraine. The Buyer also agrees that the territory of delivery of Goods sold by other Sellers may be limited.
3. Delays in delivery are possible due to unforeseen circumstances that occurred through no fault of the Seller.
4. Upon delivery, the Order is delivered to the Buyer or to a third party specified in the Order as the recipient (hereinafter referred to as the Buyer and the third party as the "Recipient"). If it is impossible to receive an Order paid in cash by the above-mentioned persons, the Order can be delivered to a person who can provide information about the Order (the number of the shipment and / or the name of the Recipient), as well as pay the cost of the order in full to the person who delivers the Order.
5. The risk of accidental loss or accidental damage to the Goods passes to the Buyer from the moment the Order is handed over to him and the Recipient of the Order signs the documents confirming the delivery of the Order.
6. In order to avoid fraud, as well as to fulfill the obligations specified in clause 5.4. of this Agreement, when delivering a prepaid Order, the person delivering the Order has the right to request a document confirming the identity of the Recipient, as well as to indicate the type and number of the document provided by the Recipient on the Order receipt. The Seller guarantees the confidentiality and protection of the Recipient's personal data.
   In case of payment of the Order by the method specified in clause 6.4.2. of the Offer, delivery is free of charge, if the order is from 2500 UAH.
7. The cost of delivery of each Order is calculated individually, based on the weight of the Product, the region and the delivery method, and is indicated on the Website at the last stage of ordering.
8. The Seller's obligation to deliver the goods to the Buyer is considered fulfilled at the time of receipt of the shipment by the Buyer, as this time is determined in accordance with the current postal rules.
1. The order of delivery and disclosure of Items containing goods is determined by the current rules of postal communication.
9. When accepting an Order from a courier, the Recipient is obliged to inspect the delivered Goods and check them for compliance with the declared quality, assortment and completeness of the Goods, as well as to check the service life of the delivered Goods and the integrity of the packaging. If there are no claims to the delivered Goods, the Recipient signs the "Order Delivery Form" and pays for the Order. The signature in the delivery documents indicates that the claims to the Goods have not been declared by the Recipient and the Seller has fully and properly fulfilled its obligation to transfer the Goods.
10. The time spent by couriers delivering goods sold by the TM "Natali Bolgar" to the Recipient's address is limited to 15 minutes.
11. To specify the date, time and, if necessary, the delivery route, you can contact the manager, who contacts the Buyer to confirm the Order.
12. The User understands and agrees that:
    delivery is a separate service that is not an integral part of the Goods purchased by the Buyer, the performance of which ends when the Recipient receives the Goods and makes a payment for it. Claims to the quality of the purchased Goods that arose after receiving and paying for the Goods are considered in accordance with the Law of Ukraine "On Consumer Rights Protection" and the Seller's warranty obligations. In this regard, the purchase of Goods with delivery does not give the Buyer the right to demand delivery of the purchased Goods for the purpose of warranty service or replacement, does not allow for warranty service or replacement of the Goods by going to the Buyer and does not imply the possibility of returning the cost of delivery of the Goods in cases where the Buyer has the right to a refund for the Goods as such, in accordance with the Law of Ukraine "On Consumer Rights Protection".

6. Payment for goods

1. The price of the goods is indicated in UAH and includes value added tax if the relevant Seller applies the general tax system.
1. The order amount consists of the cost of the ordered goods.
2. The price of the Product is indicated on the Website. In case of incorrect indication of the price of the Goods ordered by the Buyer, the Seller informs the Buyer about this in order to confirm the Order at the corrected price or cancel the Order. If it is impossible to contact the Buyer, this Order is considered canceled.
3. The price of the Product on the Site can be changed by the Seller unilaterally. At the same time, the price of the Product ordered by the Buyer is not subject to change.
4. Payment for the Goods is made by the Buyer:
1. in cash upon receipt of the Order in the amount corresponding to the Order amount specified on the Website, including discounts;
2. non-cash funds using bank cards when placing an Order in the amount corresponding to the Order amount specified on the Site, including discounts.
5. TM "Natali Bolgar" has the right to provide discounts on Products and establish a bonus program. The types of discounts, bonuses, the order and conditions of accrual are determined by the Sellers themselves and are indicated on the Website and can be changed by the Seller unilaterally.
6. TM "Natali Bolgar" keeps statistics of orders placed by the Buyer. TM "Natali Bolgar" has the right to unilaterally determine the payment methods available to the relevant Buyer, based on the statistics of actions performed by the Buyer in relations with TM "Natali Bolgar".

7. Return of goods and money

1. The return of the Product is carried out in accordance with the section "Return and exchange", indicated on the Website at the addresshttps://natalibolgar.com/return_exchange/. The Buyer has the right to refuse the received Goods and terminate the Contract of Sale within 14 calendar days from the date of receipt of the Goods, not counting the day of purchase, except for Goods that are not subject to exchange and return in accordance with clause 7.2.4. of this Agreement. The returned product, with all seals and labels, must be sent by the Buyer or by mail with the following documents attached: a hand-filled application for the return of the product. Shipping of goods is carried out at the expense of the Buyer.
2. Return of Goods of proper quality:
1. The return of Goods of proper quality is possible if the goods have not been used, their presentation, consumer properties, seals, labels have been preserved, and the payment document issued to the Buyer together with the sold goods has been preserved.
2. If the Buyer refuses the Goods in accordance with clause 7.2.1.The Seller returns the cost of the returned Goods to the Buyer within 30 days from the date of receipt of the returned Goods at the Seller's warehouse, together with the application for return filled in by the Buyer. The refund of the cost of the Goods is made exclusively to the person specified in the Order for the Goods, provided that such person provides a copy of his / her national passport, identification code and payment receipt for the Goods for which the funds are returned. If the Buyer specified incorrect data in the Order, or did not provide all the documents listed above for a refund, the Seller reserves the right to refuse such a Buyer a refund.
   
3. If at the time of the Buyer's request a similar product is not available for sale at the Seller, the Buyer has the right to refuse to perform this Agreement and demand a refund of the amount of money paid for the specified Product. The Seller is obliged to return the amount of money paid for the returned goods within 30 days from the date of return of the Goods.
   
4. Non-refundable, hosiery, underwear, perfumes and cosmetics, jewelry, etc. (in accordance with Annex No. 3 to the Resolution of the Cabinet of Ministers of Ukraine of March 19, 1994 M 172).
3. Return of Goods of improper quality:
1. A product of improper quality means a product that is defective and cannot ensure the performance of its functional qualities. The received Product must match the description on the Website. The difference between the design elements or design from those stated in the description on the Site is not a sign of the improper quality of the Product and / or the inability to use it for its intended purpose.
2. The appearance and completeness of the Goods, as well as the completeness of the entire Order, must be checked by the Recipient at the time of delivery of the Goods.
   
3. After receiving the Order, claims for external defects of the product, its quantity, completeness and presentation are not accepted.
   
4. If the Goods of improper quality were transferred to the Buyer and otherwise was not agreed in advance by the Seller, the Buyer has the right to use the provisions of Article 8 "Consumer rights in case of purchase of goods of improper quality" of the Law of Ukraine "On Protection of Consumer Rights".
   
5. Claims for a refund of the amount of money paid for the goods are subject to satisfaction within 30 days from the date of submission of the corresponding claim (paragraph 4 of Article 12 of the Law of Ukraine "On Consumer Rights Protection").
4. The refund is made by returning the cost of the paid Goods by mail, bank transfer, as well as by transfer to a bank card (the card must be issued on the territory of Ukraine; the currency of the card is hryvnia). The method must be specified in the corresponding field of the return request.
5. In the case of payment of the Order by the method specified in clause 6.4.2. of the Offer, the refund is made by returning the cost of the paid Goods to the bank card with which the Goods were paid.
6. The warranty period for the Products is set by the manufacturer and is indicated on the label or on the label. The seller ensures the proper use of the goods during the warranty period.
7. The Seller is not responsible for the defects of the Goods, if they occurred after its transfer to the Buyer as a result of the Buyer's violation of the rules of use or storage of the goods, the actions of third parties, or force majeure.

8. A responsibility

1. The Seller is not responsible for any damage caused to the Buyer as a result of improper use of the Goods purchased in the Online Store.
2. The seller is not responsible for the content and operation of external sites.

9. Confidentiality and information protection

1. Personal data of the User/The Buyer is processed in accordance with the Law of Ukraine of June 01, 2010 No. 2297-VI "On the protection of personal data".
2. Personal data of Buyers is stored in the Seller's database at 103 Chernomorskogo Kazachestva str., Odessa, 65003. Personal data is collected solely for the purpose of complying with the requirements applicable to the regulation of tax relations, accounting relations and advertising relations. The term of storage and processing of personal data is 5 years.
3. When registering on the Site, the User provides the following information: Last name, First name, email address, contact phone number and password to access the Site.
4. By submitting your personal data when registering on the Site, the User agrees to their processing by the Seller, including for the purpose of promoting goods and services by the Seller.
5. The Seller uses the User's personal data/The buyer:
• to register the User on the Site;
• to fulfill its obligations to the User/By the buyer;
  
• for evaluating and analyzing the Site's performance;
  
• to determine the winner in the promotions held by the Seller.
6. The Seller has the right to send informational messages, including advertising messages, to the User's email and mobile phone/The buyer with his consent. User/The buyer has the right to refuse to receive advertising and other information without explaining the reasons for the refusal. Service messages informing the User/The Buyer's information about the order and the stages of its processing is sent automatically and cannot be rejected by the User/The buyer.
7. The seller has the right to use the "Cookies" technology. "Cookies" do not contain confidential information and are not transmitted to third parties.
8. The seller receives information about the ip address of the Site visitor natalibolgar.com. This information is not used to identify the user.
9. The Seller is not responsible for the information provided by the User/By the Buyer on the Site in a publicly available form.
10. The Seller has the right to record telephone conversations with the User/The buyer. At the same time, the Seller undertakes to: prevent attempts of unauthorized access to information obtained during telephone conversations, and/or transfer it to third parties who are not directly related to the execution of Orders, in accordance with the Law of Ukraine of 02.10.1992 No. 2657-XII "On Information".

10. The validity period of the Public Offer

1. This Public Offer comes into force from the moment of its acceptance by the Site User/By the Buyer, and is valid until the moment of revocation of the acceptance of the Public Offer.

11. Additional terms

1. The Seller has the right to assign or in any other way transfer its rights and obligations arising from its relations with the Buyer to third parties.
2. The online store and the services provided may be temporarily partially or completely unavailable due to maintenance or other work or for any other technical reasons. The technical service of the Seller has the right to periodically carry out the necessary preventive or other work with or without prior notice to the Buyers.
   
3. To the relationship between the User/The Buyer and the Seller apply the provisions of the legislation of Ukraine.
   
4. In case of questions and complaints from the User/The Buyer can contact the Seller by phone or in any other available way. The parties will try to resolve all disputes that arise through negotiations, and if an agreement is not reached, the dispute will be referred to a judicial body in accordance with the current legislation of Ukraine.
   
5. The court's recognition of the invalidity of any provision of this Agreement does not entail the invalidity of the remaining provisions.
   
6. If the Order is paid in the manner specified in clause 6.4.2. of the Offer, an additional commission may be charged by the issuing bank.
   
7. TM "Natali Bolgar" provides the site visitor with/To the user/The buyer can search for products by photos ​(hereinafter referred to as the"Photo Search" service). As part of the operation of the specified service, the site user/User/The buyer agrees to the use of the image and understands that it is fully responsible to third parties for its use. TM "Natali Bolgar" is not aware of the sources of uploaded photos and /or any other images. The search is carried out exclusively within the database of sales offers used by TM" Natali Bolgar " legally.
